Are we right to a lawsuit involving an accident on the job with a defective machine?

My husband was injured at work two days ago, which required emergency medical care and surgery. He came close to losing his whole hand in an accident of meat grinder. The mill was supposed to have a safety mechanism, where if you lifted the lid, the machine would be cut off, but it did not work no. I guess he will receive workers' comp. benefits, but is it malfunctioning security grounds for a lawsuit? It looks like his hand will never be fully functional. I fear that his career as a meat cutter is over. He has no job he can do and his age is a factor (58). I fear it will be unable to work enough after this accident.

I think you have a helluva case! It is a requirement OSHA's that All Machines in the workplace are inspected and in working order. Obviously, this one was not that it is certainly the fault of his employers. And I disagree that you do not have a case if your husband has security did not work. It is still the responsibility of employers to have this fixed to prevent exactly what happened to your husband happen to anyone. And I think it makes you have a case yet better, as it was then known that the security was not working. I can not imagine that you have trouble getting a lawyer to take this and why in the world, you do not win. It should now apply for disability because it can take up One year it is approved (or more). He probably will not be able to work again and if it can not work, so no income to come, you guys are going to be bad for the money. The trial will take a long time and therefore most likely will be disabled. Getting started the two immediately.
